The National Democratic Coalition (NDC) of Liberia has condemned the unconstitutional removal of Associate Justice kabineh Mohammad Ja’neh by the Legislature of the Republic of Liberia.
The NDC believes that the action of the legislature was unconstitutional and illegally executed with the cooperation of Chief Justice Francis Korkpor. Such illegal and unconstitutional action has severely undermined the independence of the Judiciary and degraded the national legislature. Also, such illegal removal of Associate Justice Ja’neh has the propensity to induce lawlessness and provoke illegal or unsolicited attacks on the legislative and executive branches of government. The illegal removal process of Associate Justice Ja’neh is a misdirection of government’s energy at a time when efforts should be directed at improving the living standards of the Liberian people and creating the enabling environment for the attraction of investors in the dying economy.
By the unconstitutional removal of Justice Ja’neh, the violation of the principle of separation of powers has brought global embarrassment to Liberia and individual citizens of the country. Obviously, the decision against Justice Ja’neh implies the need to dissolve the entire bench of the Supreme Court of the Republic of Liberia on grounds that all sitting justices participated in the very decision of the so-called “Road Funds” on which Justice was unconstitutionally removed from the Supreme Court. On the other hand, the Legislature of the republic of Liberia will be well advised to revoke the so-called impeachment of Justice Ja’neh.
In defense of the Comprehensive Peace Agreement of 2003 and the Constitution of Liberia, the NDC sees the need for the redirection of government efforts to purposes of social economic development, reconciliation, peace-building, and the stability of the democratic state. The NDC strongly believes that only a corrigible government can succeed to lead such a process.
Meanwhile, the NDC has, with immediate effect, expelled Senator Henry Yallah of Bong County and Senator Francis Paye of Rivercess County for associating with the unconstitutional behavior of the executive pawns in the spineless Legislature to undermine the independence of the Judiciary and degrade the high integrity of the legislative branch of government in the Republic of Liberia.
Therefore, the NDC advises all well-meaning Liberians that the general worthlessness and corrupt behaviors of Mr. Henry Yallah and Francis Paye should be noted as attitudes that are detrimental to the construction of democratic civilization and not worthy of emulation. For that very reason also, the NDC calls on all the constituencies of the senators that participated in the unconstitutional removal of Justice Ja’neh to vote against their elected officials in the 2020 and 2023 senatorial bi-elections.
This decision of the NDC, Liberia’s social democratic coalition, was taken in an Executive committee meeting that lasted for two days (from April 4 – 5, 2019). source/www.smartnews.com
